CALLER: Okay. I’ll be 14 in March. Is that okay? My friend told me that my parents have to sign some stuff. But my —
CLINIC: They do, sweetie. Under 18 you cannot have that done as a service. In Indiana it’s a state law without parental consent.
CALLER: Oh, well. My boyfriend’s 22. Could he sign it or anything?
CLINIC: No. Your boyfriend has nothing to do with you legally.
CALLER: Oh. Is there any way not to tell my parents?
CLINIC: I don’t think so, sweetheart. You can call and talk to the, but no, I don’t believe so. In the state of Indiana it’s a state law anybody under 18 has to have parental or a legal guardian consent.
CALLER: Okay. Well, if I wasn’t pregnant, could I get birth control from you guys?
CLINIC: If you aren’t pregnant, we can provide it as a service, yes.
CALLER: Okay.
CLINIC: But state law will not allow a minor under the age of 18 to have a termination without parental consent.
CALLER: Oh, okay. But if I was on birth control like — I’m not real sure if I’m pregnant. But if I wasn’t and I was getting birth control from you guys, do you have to tell anybody anything?
CLINIC: No, we do not because we are protected by the state law because we provide sexually transmitted infection testing and treatment.
CALLER: Oh, okay.
CLINIC: Okay?
CALLER: All right.
CLINIC: We will tell you that — we encourage everybody under 18 — it’s part of our guidelines. We tell everybody, we encourage you to involve your parents. We’re not here trying to be sneaky. We encourage parental involvement. We tell everybody that we want them to talk to their parents. But I will tell you that we can provide you a service. But if you are 14 or under 14 and sexually active, we have to also give that information to the Child Protective Services. That’s also a state law.
CALLER: So you’d have to tell on me if I was on birth control?
CLINIC: Yes, ma’am. We would have to. If you’re sexually active, and if we have that information, we would have to let Child Protective Services know, yes.
CALLER: Well, what can I do then?
CLINIC: Sweetheart, there’s probably nothing you can do. Talk to an adult. Talk to a parent. If you’re 14 and having sex with somebody — and I wish you hadn’t even told me. He could be arrested for —
CALLER: Arrested?
CLINIC: Absolutely.
CALLER: I don’t — but —
CLINIC: Listen to me. Because the law says, if he is having sex with a minor, and you’re 14 and he’s 22 years old, there’s something not quite right there. I don’t care how old you are, you’re young. You’re considered in the eyes of the law a minor.
CALLER: But we’re in love. We’re going to get married.
CLINIC: Well, sweetheart, if you were married, that’s a different story. But you can’t even get married without the consent or the signature of an adult. So you are not considered able to do those things. Okay?
CALLER: Well, what should I do.
CLINIC: I’m going to encourage you to quit having sex with him, first of all, until you can get this all lined out. Talk to an adult. If you don’t trust talking to your parents, talk to a school counselor. Talk to a minister. Talk to somebody that you’re comfortable with. You need to find out whether or not you’re pregnant, okay? That’s the first thing you need to do, find out whether or not you’re pregnant. If you’re not, then you need to consider a type of birth control if you’re going to be sexually active. But I’m going to strongly encourage you to not be involved with this person until you get things all lined out legally, because there’s just a lot of ramification. If you continue to have sex with this person, if your parents wanted to, they could press charges. And yes, he could be arrested for statutory rape. And he should know that himself.
CALLER: Okay. But you’re not going to tell on me?
CLINIC: Do what?
CALLER: You’re not going to tell on me?
CLINIC: We don’t even have your name, okay?
CALLER: Okay.
CLINIC: So no. I’m giving you good, straight-forward advice. Please protect yourself. Please stop having sex with him until you can get things evaluated, okay?

CLINIC: I don’t have your name, so I’m not going to tell anybody. But what I’m telling you, if you come here and you want a service from us, we want to help you, and we will do what we can. But I’m going to be up front with you and tell you, at 14 and under if you are sexually active, we have to by law report that to Child Protective Services.
CALLER: So I can’t get birth control from you guys?
CLINIC: I did not say that. I told you that if you came here and you’re sexually active, we have to report it. That’s all I’m telling you. We can provide you —
CALLER: Oh. But could I get birth control?
CLINIC: Yes, but you’re going to have to have it reported that you were sexually active. And I can’t tell you what happens then. But yes, you can get birth control through us. Okay?

CALLER: Like what?
CLINIC: It’s against the law. He could go to jail?

CLINIC: But it’s statutory rape.
CALLER: What? But he’s not raping me.
CLINIC: Even if you’re consenting and you’re 13 years old, you’re not a legal adult in the state of Indiana, and it does not matter. So if you call the clinic to have a termination done, the only way that you can get that done in the state of Indiana is if your parents sign for that or you’re emancipated from the state. And you have to do that through a court in Indiana. And no judge will order emancipation if it’s just to get a termination done.
CALLER: Oh. Well, how would I do that then?
CLINIC: Do what?
CALLER: Could I go to the judge and be emancipated?
CLINIC: Mm-hmm. There’s like a three-month waiting period for that, and your parents have to sign your rights away.
CALLER: They do?
CLINIC: Uh-huh.
CALLER: Well, what can I do then? Where could I go?
CLINIC: You can go out of state. There’s clinics out of state that will do terminations without parental consent.
CALLER: And they wouldn’t have to tell anybody?
CLINIC: Without parental consent, yes. But I mean that’s out of state. And I believe you stay over 24 to 36 hours.
CALLER: Oh, okay.
CLINIC: The only other way is for your parents — and they have to show identification, like a drivers license with their picture on it that they are your parents. Okay?
CALLER: Okay. Well, could I come in there for a pregnancy to see?
CLINIC: You don’t even know if you’re pregnant or not?
CALLER: Well, I’m just scared because I missed my period so .
CLINIC: Yeah. First before you start calling abortion clinics I would definitely verify that you’re pregnant.
CALLER: Well, could I come to you guys and get —
CLINIC: Sure. Sure. They’re $5, and we can do them any day that we’re open. We’re closed on Tuesdays.
CALLER: Well, what would I tell my parents? Would you guys have to say anything or anything?
CLINIC: We would not notify your parents. But I would tell you when you come in do not tell me that you’re 13 years old and having sex with a 22-year-old.
CALLER: Well, he has to bring me.
CLINIC: Tell me he’s your brother.
CALLER: Oh, okay.
CLINIC: Because, I mean, if you come into any Planned Parenthood and you’re under the age of 14 and sexually active, we have to turn you over to Child Protective Services anyway. But if you’re having sex with a 22-year-old and you’re under the age of 14, that has to be taken care of too. I mean, that’s statutory rape. It’s against the law. It’s illegal.
CALLER: Oh. But I could come in for a pregnancy test, and you guys wouldn’t have to tell anybody anything?
CLINIC: Hang on just a second, okay?

CLINIC: Okay. If you come in to a Planned Parenthood facility under the age of 14, yes, we do have to contact Child Protective Services.
CALLER: So I couldn’t even come in for a pregnancy test?
CLINIC: That’s completely up to you as to what you do. But if you come in here — and then of course once you’re contacted by CPS, they will contact your family.
CALLER: Oh. Well, how would you know my age?
CLINIC: Because you have to fill out a form with your birth date and age on it.
CALLER: Oh.
CLINIC: You know and then the situation is to that you’re telling me that you’re 13 and sexually active with a 22-year-old which that’s — like said, it has to be turned over. So yes, if you would come into a Planned Parenthood facility, yes, we would have to turn you over to Child Protection Services.
CALLER: Well, what can I do?
CLINIC: I would assume, to take a home pregnancy test if you didn’t want to go through all of that. But if the test is positive — I mean, if you’re wanting a termination done, it’s going to have to be done with parental consent.
CALLER: Well, are the home pregnancy tests usually accurate?
CLINIC: If you’re late for a period, yes. At 13 if you’re having sex anyway — other than with a 22-year-old — I would make him use a condom or protect myself from pregnancy. I mean, you’re obviously not wanting to be pregnant, and you’re afraid your parents are going to find out. I would get myself on a birth control method to protect yourself from that.
CALLER: But if I wasn’t pregnant, could I come in there and get birth control?
CLINIC: We would have to call Child Protective Services, yes. It sounds like it would be a thing that you maybe need to sit down and talk to your family.
CALLER: I can’t. I don’t know what they would do. I just can’t tell them. I’ll be 14 in March. Would that make any difference?
CLINIC: Probably not, not with this situation.
CALLER: Oh. Well, I’m just really scared.
CLINIC: I would do a home pregnancy test to verify first of all. And then you need to remember the situation — if that test is negative, you need to remember what you’re feeling right now. You need to do something to protect yourself, either abstain from intercourse. I mean, don’t have sex with him or get condoms, use condoms. Protect yourself the best as you can. I mean it’s your body. You need to protect that.

CLINIC: If you need anything, you let me know. But like I said, I would love to be able to help you in any way I can, but I have to follow the guidelines of Indiana state law, and that’s what I have to do. CALLER: Yeah. Well, like my last period was like the second week in December.
CLINIC: Okay. Have you taken a pregnancy, a home pregnancy test?
CALLER: Well, no.
CLINIC: Okay. Well, yeah, you can come here and get a pregnancy test if you want.
CALLER: How much does that cost?
CLINIC: It’s $5.00.
CALLER: Okay.
CLINIC: And you need to be here — you don’t need an appointment, but you do need to be here before like 4:00, an hour prior to closing any day.
CALLER: Okay. Well, would you guys have to tell anybody?
CLINIC: No.
CALLER: Okay.
CLINIC: No. We just — there’s just some papers you need to fill out to get you in the computer, and then we’ll run the test.
CALLER: Okay.
CLINIC: We don’t, we don’t — no. We don’t need anything for that.
CALLER: Okay. Well, my boyfriend will bring me. Is that —
CLINIC: That’s fine.
CALLER: Okay.
CLINIC: But you have to be here — today we close at 5:00, so we do not do pregnancy testing after 4:00.
CALLER: Oh. Well, I’d have to call him to see when he can get off work to bring me. But, what was your name?
CLINIC: My name is Charlene.
CALLER: Okay.
CLINIC: Okay?
CALLER: If like the pregnancy test was negative do you guys do birth control there?
CLINIC: Yes.
CALLER: And you wouldn’t have to tell anybody about that either?
CLINIC: No. Right.
CALLER: Right?
CLINIC: So we can give you some information then on that too when you come in.
CALLER: Okay.
CLINIC: Okay?
