CALLER: Well, do you know — like I’m just worried because like, well, I’m going to be 14 in March, and my friend told me that they would have to tell my parents I was getting an abortion. But my boyfriend’s 22. Is he old enough to take care of all that and —
CLINIC: No.
CALLER: — they wouldn’t have to tell anybody?
CLINIC: No. If you’re not legally married to him, no, he cannot.
CALLER: Really?
CLINIC: No. He cannot. If you’re only 14?
CALLER: Yeah. Well, I’ll be 14 in March.
CLINIC: You have to go through the legal process called Jane’s Due Process.
CALLER: Okay. What is that?
CLINIC: That’s where you try to obtain an abortion without your parents’ consent.
CALLER: Okay. Well, how much does that cost?
CLINIC: It’s a legal process that you would go through. I don’t think they charge you anything for the paperwork and all that. But, you know, you would have to pay for the abortion itself.
CALLER: Oh, well, do they have to tell my parents or anything?
CLINIC: Those start at $435.
CALLER: Oh. Well, do you know if they have to tell my parents?
CLINIC: No. When you would do Jane’s Due Process, you would petition the court. In other words, you’re petitioning a judge.
CALLER: Oh. Well, does the judge ever say no?
CLINIC: I don’t know. I don’t think so. I think this is what happens, you go through kind of a little survey with them and they see where you’re at with wanting to have that done. If the judge does not respond — I think he has two days to respond to it. If he doesn’t then automatically you get it.
CALLER: Oh, really?
CLINIC: Um-hum.
CALLER: Okay.
CLINIC: But I mean, you would have to go through court to get it done without your parents’ consent. And another thing, if that guy is 22 years old, I mean why — and you’re 14?
CALLER: Well, I’ll be 14 in March.
CLINIC: You’re just 13?
CALLER: Uh-huh.
CLINIC: And he’s 22?
CALLER: Yeah.
CLINIC: Okay, first of all, he’s going to jail.
CALLER: Why is he going to jail? What for?
CLINIC: Because, that’s statutory rape. You’re 13 years old.
CALLER: But he’s not raping me. I mean, we’re in love. We’re going to get married.
CLINIC: I know. But you cannot – even with consent – you can’t have sex with a person that’s 13 and you’re 22.
CALLER: Well, he can’t go to jail. I mean —
CLINIC: Well, you know, any place would have to report it.
CALLER: Well, any place I go, you mean?
CLINIC: Uh-huh. He would be reported.
CALLER: Well, I really just wanted to get a pregnancy test. I’m just really worried because like I haven’t had my period since like December 21st, and I’m just scared. I don’t know what to do.
CLINIC: Okay. But I’m just telling you, we do have to report it. You know?
CALLER: Even if I come in for a pregnancy test?
CLINIC: Um-hum. We do have to report it.
CALLER: Well, what can I do then?
CLINIC: Because you are a minor, and he’s an adult.
CALLER: Well, I don’t want him to go to jail.
CLINIC: Well, I mean —
CALLER: Is there anything I can do?
CLINIC: — a 13-year-old cannot give consent as far as having sex. At 22, you should not, you should know better than to have sex with a 13-year-old.
CALLER: Well, what can I do?
CLINIC: You said he takes care of you? Talk to him and see what happens.
CALLER: But he told me to call you guys.
CLINIC: Okay.
CALLER: I mean, we’ve been talking about this.
CLINIC: But that shows that he’s not very mature though. So now, you got to think of what’s the next best thing for you to do.
CALLER: Right. What would that be?
CLINIC: Because if he’s 22 and you get pregnant and he don’t know what to do for you?
CALLER: Yeah?
CLINIC: Then what kind of — how is he taking care of you?
CALLER: Well, I don’t know.
CLINIC: That’s no help. He should have a solution for you. That’s taking care of a person. Taking care of a person is when they come to me and I tell, I can tell them exactly what we’re going to do. Not send them to someone else.
CALLER: Yeah?
CLINIC: You know, he should bring you himself. He should — First of all, when is the last time you had a period?
CALLER: December 21st.
CLINIC: Okay. You haven’t had a period since December 21st?
CALLER: Right.
CLINIC: How long have you had your periods, honey?
CALLER: Well, like a couple years.
CLINIC: Okay. You’ve already had them for a couple of years. And are they regular?
CALLER: Yeah.
CLINIC: They come each month?
CALLER: Uh-huh.
CLINIC: Okay, and near the same time?
CALLER: Yeah.
CLINIC: Okay. Have you had any other symptoms?
CALLER: No.
CLINIC: Like being sick at the stomach?
CALLER: No.
CLINIC: No vomiting?
CALLER: Uh-uh.
CLINIC: Sore breasts?
CALLER: No.
CLINIC: Okay. Pains in the abdomen?
CALLER: No.
CLINIC: So why do you think you’re pregnant?
CALLER: Well, I just haven’t had my period for a couple months now.
CLINIC: Okay. Did you go to HEB and buy a pregnancy test?
CALLER: No.
CLINIC: Okay. Make him do that for you.
CALLER: Oh. Well, are those usually right?
CLINIC: Yes, they are. You know what you’re going to do? Write down this name. You’re going to get a Fact-Plus REPT, early pregnancy test. Those are most like the ones that we use here.
CALLER: Oh, okay. Well, if it turned out that I wasn’t pregnant, could I come in there and get birth control though?
CLINIC: Yeah, sure.
CALLER: But would you guys have to tell anybody?
CLINIC: No. Not about the birth control. But if you test pregnant and you’re 13, we do have to report that.
CALLER: Oh, okay.
CLINIC: I’m just telling you so that you’ll know, you know, and it won’t be any confusion when you come here.
CALLER: Okay.
CLINIC: Because at 13 we would have to report it.
CALLER: Well, if I was on birth control, would he be able to pick up the pills? Because I can’t drive. I’m not old enough.
CLINIC: Yeah. You could leave a note with your chart saying that, you know, you give such and such a person permission to pick up your pills.
CALLER: Oh, okay.
CLINIC: Um-hum. But go ahead and go and — I mean, have him to buy you a pregnancy test and do that one.
CALLER: All right.
CLINIC: And then, you know, if you are, if it says positive, then you’ll know where to go from there. If it says negative, then obviously you won’t have to have any worries. Right?
CALLER: Right.

CLINIC: Basically, right now, all you’re trying to find out is if you are pregnant or not, right?

CALLER: No. I didn’t know that the home ones were any good.

CLINIC: Well, it should be free. It just takes a little bit of time. And there’s actually a place here in town that specializes in that, and if you’ll — if I can put you on hold for a second, I’ll get their phone number.

CLINIC: And tell me what — the judicial bypass is a fairly straightforward thing here in Austin, and I know abortion clinics can certainly help you with that too. Do you have any idea how far along you are?
CALLER: Not really. I’m just really worried because like my last period was like December 21st, so.
CLINIC: Oh, okay. You can come here for a pregnancy test if you want.
CALLER: Really?
CLINIC: Yeah, and it costs $20.
CALLER: Oh, okay. Well, that would be cool. But would you guys have to tell my parents about that though?
CLINIC: No, we wouldn’t, except that anyone who’s 13 or under who has a positive pregnancy test — and this is anywhere in Texas, including the clinic — is required by law to make a phone call to the Child Protective Services.
CALLER: Why?
CLINIC: Just because it’s kind of a warning sign. It tends to be that people who are pregnant when they’re under 14 years old, it just happens that a higher percentage of those people are victims of abuse.
CALLER: Really? But I’m not being abused. Like my boyfriend, we’re in love. We’re going to get married.
CLINIC: Yeah. Yeah. And that’s great, and Child Protective Services probably wouldn’t even call. I just kind of wanted to give you a heads up about that because that’s a good thing to know beforehand. That’s not — I’m sure that they would just make the phone call and then nothing else would happen. And certainly we would tell Child Protective Services to not call because you don’t want your parents to know and all that kind of stuff.
CALLER: Yeah. Well, what do you mean there’s like a higher percentage? I mean —
CLINIC: Well, it happens that — Okay, imagine this. If like a 9-year-old was pregnant. I mean, to me that would be a problem.
CALLER: Yeah.
CLINIC: Yeah, she probably wasn’t wanting to be pregnant. And you sound like you’re really together, and you know to call us, and you’re going to do the next steps, and that’s fine. So you’re a little bit different. But someone who’s 10 years old and pregnant, a lot of times that’s not a good situation for her to be in. And that happens sometimes to people who are 11 years old too. So you sound like you’re a little bit different from the average, but there are just — it tends to be that when people are like 11 years old, 12 years old, even 13 years old sometimes when they’re pregnant that’s kind of a red flag. Sometimes saying maybe we should check into this situation to make sure they’re okay. For us, checking into that situation that’s all we need to hear is you say that you’re fine and you guys are happy, and that kind of thing, and that it’s your choice to have sex.
CALLER: Oh. So if we were all right, you wouldn’t have to tell anybody?
CLINIC: Well, we would still have to call, but that would be the end of it. All we have to do is write down a case number so that basically they know that we checked with you to make sure that you were okay. Yeah. So we definitely would not tell your parents. Child Protective Services probably wouldn’t either.
CALLER: Okay. It’s just me and my boyfriend have been talking about this, and we don’t, we just don’t want anybody to know about us.
CLINIC: Yeah. No, for sure. And all of our services — beyond that law, I mean, that’s the law by the state of Texas, and beyond that law we certainly would respect your confidentiality.
CALLER: Oh, okay.
CLINIC: Yeah. Yeah. I just wanted you to kind of know about that beforehand.
CALLER: Okay. But —
CLINIC: Yeah. But other than that, no, you’re fine. And I really — Yeah. No, you’re fine. It’s nothing to be concerned about. I just wanted to let you know.

CLINIC: They will be like asking that question.
CALLER: So like if my boyfriend was there with me, would you guys have to tell on him or anything?
CLINIC: Oh, no. Uh-uh.

CLINIC: No, we wouldn’t.

CALLER: Even if like it turned out that I wasn’t pregnant?
CLINIC: If you weren’t pregnant? Then we wouldn’t have to do anything.
CALLER: Oh, okay. Well, could I get on birth control if I wasn’t pregnant?
CLINIC: Absolutely. Yeah, you can do that with us.
CALLER: And you wouldn’t have to tell anybody about that either?
CLINIC: No, not at all. That’s a good question, but we don’t tell anybody about that stuff. It’s just that the state of Texas says if there’s a positive pregnancy test then we have to do this.

CLINIC: In Round Rock? Okay. Well, most likely you’ll come to court here, and your attorney will help you do everything. And most of the girls that we see in Travis County, which is in the Austin area, haven’t been turned down.
CALLER: Well, how much does it cost for an attorney?
CLINIC: It’s not going to be any cost to you.
CALLER: Oh, okay.
CLINIC: Yeah, whatsoever. All we would need you to do is — Do you have like a way that you can get around and stuff like that?
CALLER: Well, my boyfriend drives me.

CLINIC: But as far as going through with the abortion procedure, that’s definitely what you want to do?
CALLER: Yeah.
CLINIC: Yeah?
CALLER: Yeah, me and my boyfriend, that’s all we talk about now. But he’s a great guy, and we’re going to be married soon. But he has to finish school and stuff. So we just can’t have a kid until after that. So that’s we were wanting to get an abortion, because we can’t have a kid right now.
CLINIC: Okay. And when did you say you were turning 14?

CLINIC: Yeah. Okay. What I can tell you is — Do you have any questions about the actual law in Texas? Do you understand about that a little bit?
CALLER: I just don’t want to tell my parents.
CLINIC: Okay. That’s fine. You don’t need to. The law does protect you from needing to tell your parents. What is required by the state of Texas is that your parents are informed; they don’t need to give consent. And if you want to bypass that, the state is required to give you a free lawyer who represents you at a local court. Do you live in Travis County or do you live in a different county?
CALLER: I live in Austin.
CLINIC: You live in Austin. Okay. So you live in Travis County. There’s an organization called Jane’s Due Process. Have you heard about them?
CALLER: No.
CLINIC: Okay. What they do is they specifically are set up to help young women like you to find the representation that you deserve and need. Okay?
CALLER: Okay.
CLINIC: So you don’t need to pay anything. And it happens pretty fast. So when you talk to — I’m going to give you their number, and they’ll set you up with what is called a — You don’t need to write it down or anything, but just so when you hear this name, and you’re like, oh, yeah, Kit told me about that at the clinic. It’s called a “guardian litem.” And it’s like a fancy Latin word, for basically meaning someone who represents you in court. And when you go to court it’s a really brief visit. But the guardian litem is going to be there to sort of walk you through it and kind of hold your hand. Okay?
CALLER: Well, would the judge say that it’s okay then?
CLINIC: Uh-huh, yeah. You just have to answer some questions and have an appointment set up with us and stuff like that. Sometimes they’ll recommend that you had come in and visit with us first before you go meet with a judge so that you understand about the procedure and everything. So we can set up an appointment for you for, you know, what we call a pre-operative visit, where you get your ultra sound and your lab work and your counseling. And then you’ll be all informed and know what to expect and everything. And then in the next day, you would go and meet with your guardian litem, and then you get some paperwork done. And then you come back to us like the following day. So it all happens within like a 24 to 48-hour period.
CALLER: Okay.
CLINIC: Are you in high school or are you out of school?
CALLER: I’m home-schooled.
CLINIC: Okay. And how old are you?
CALLER: I’m going to be 14 on the 19th.
CLINIC: Okay. Okay. What I can do is —
