CALLER: Oh, okay. Well, do you know — Like I’m just really worried because like my friend told me that — Like I’m going to be 14 in March, and she said that they would have to tell my parents. But my boyfriend’s 22. Could he just sign whatever it is and they wouldn’t have to tell anybody?

CLINIC: Let me — (unclear, talking to someone else at the clinic) Let me tell you something, ma’am.

CALLER: Uh-huh.

CLINIC: By you being 14 and your boyfriend is 22, it’s going to be reported also to the law.

CALLER: Why?

CLINIC: Because it’s considered statutory rape.

CALLER: But he’s not raping me. I mean, we’re in love. We’re going to get married.

CLINIC: I understand that.

CALLER: What could happen?

CLINIC: Let me — Don’t get angry, ma’am. I’m just telling you what’s going to happen, okay?

CALLER: Um-hum.

CLINIC: That means he’s three years older than you are.

CALLER: Um-hum.

CLINIC: Okay? I wouldn’t even bring this up if I were you.

CALLER: Oh, okay.

CLINIC: Okay? Because if you do, yes, this is considered statutory rape, and he will be prosecuted for a rapist, okay? Regardless of your consenting it. Another thing is, yes, you do need a parental consent for this abortion or you would have to go in front of a judge and get the permission to get it. If you don’t want your parents to find out, you need to get a judge consent.

CALLER: Well, how much does that cost?

CLINIC: It’s just going to be depending on how far along you are.

CALLER: Oh. Well, how do you know?

CLINIC: From your last — Are you sure you’re pregnant now?

CALLER: Not really. I’m just scared because like my last period was like December 21st.

CLINIC: Okay, and you haven’t had a pregnancy test done?

CALLER: No. Could I come in there for that?

CLINIC: You can.

CALLER: But would you have to tell anybody?

CLINIC: I don’t want to know who you are, okay? Put it that way.

CALLER: It’s just, the thing is, like I’m not old enough to drive, and my boyfriend would be the only one that could take me. But would he be reported if he took me?

CLINIC: If he sat outside, no.

CALLER: Okay.

CLINIC: But like I said, if anybody finds out that he’s three years older than you are, this is considered rape.

CALLER: Okay.

CLINIC: Especially with the new laws that there is. Thank God that you’re not 13, because if you were 13 things would be worse.

CALLER: But I’ll be 14 in March. I am 13 right now.

CLINIC: Oooh. Okay. Let me tell you one more thing before you come in. If I do have a positive result, I do have to report you.

CALLER: Oh.

CLINIC: I do have to report you, by law. If I do have a positive pregnancy test on you, I will have to report you.

CALLER: Well, is there any way to get a pregnancy test without coming in?

CLINIC: Hold on. Unless you — Have you bought one over the counter at like Walmart, HEB?

CALLER: No. Are those usually right though?

CLINIC: If you do them correctly, they should be.

CALLER: Really?

CLINIC: Um-hum.

CALLER: Okay. Well, if that came out that I wasn’t pregnant, could I come over there to get birth control?

CLINIC: We can get you started on something, yes, ma’am.

CALLER: But would you have to tell anybody though?

CLINIC: Okay. If any of your results — Okay. No. But if any of your results did come back positive, yes we would have to.

CALLER: Oh, okay.

CLINIC: You don’t have to give us the information that your boyfriend is 13 — I mean 22. But then if I have any positive results like say chlamydia, gonorrhea, syphilis, any of the sexually transmitted infection results do come back positive, yes, definitely we will have to report it anyway.

CALLER: Oh.

CLINIC: Okay?

CALLER: So I can’t get birth control until I’m tested though?

CLINIC: Well, we’ll give you some, but we will test you at the time.

CALLER: Oh. But if any of the tests come back where I’m positive then —

CLINIC: Yes. Then we would have to by law.

CALLER: Well, do you know — Like the thing is I can’t drive. So would my boyfriend be able to pick up like the birth control pills?

CLINIC: He would have to — Hold on, ma’am.

CLINIC: Ma’am?

CALLER: Uh-huh.

CLINIC: Okay. Like I said, we will be glad to help you out as much as we can, but if I do have any positive results, I will definitely have to report you by law.

CALLER: Oh. Well, all right. Well, thanks for answering all my questions. I just don’t have anybody to talk to, so. Okay.

CLINIC: The thing is that if you’re nervous also, that will also make your period be held up. Are you irregular in your periods, or —

CALLER: Usually.

CLINIC: Usually? Okay. Are you having any nausea, breast tenderness?

CALLER: No.

CLINIC: Feeling tired?

CALLER: No.

CLINIC: No? Like I said, we can do a pregnancy test on you, and if it’s negative yes we can see you this afternoon, and we can do a complete physical exam on you, and we can check you for everything and get you started on a method of birth control. But if by your boyfriend being 22, it’s not correct. Not correct, because for the fact that you’re still very, very young and actually he knows more than what you do, and he is considered an adult.

CALLER: Okay. Well, I’m going to — I just really need to think about all this. I’m going to run out and get a pregnancy test. But could I call and talk to you if I had any other questions?

CLINIC: Sure. You may.

CALLER: What was your name?

CLINIC: Marie.

CALLER: Okay.

CALLER: Oh. Well, he was going to pay for everything. Does he have to sign anything, or anything?

CLINIC: No.

CALLER: Really? All right. But nobody would have to know about him or anything?

CLINIC: No. Um-um.

CALLER: Okay. Well, if it turned out that I wasn’t pregnant after the pregnancy test, could I come in or could I get birth control the same day?

CLINIC: No. You have to make an appointment.

CALLER: Oh. Well, do you — Would you after the appointment though could I get birth control and you wouldn’t have to tell anybody that I was on birth control?

CLINIC: No. You have to just make an appointment.

CALLER: Oh, okay.

CLINIC: Did you want to make an appointment now?

CALLER: Well, yeah, I guess. I just don’t know.

CLINIC: What is your date of birth?

CALLER: It’s March 19, 1988.

CLINIC: And how old are you?

CALLER: I’ll be 14 in March.

CLINIC: So you’re 13.

CALLER: Yeah.

CLINIC: Okay. You do have to realize that it has to be reported that you are sexually active. It has to be reported to CPS because of your age.

CALLER: How come?

CLINIC: Because of your age.

CALLER: Would they — would I get in trouble?

CLINIC: I mean, it has to be reported whether CPS follows up on it, that’s a different situation. But we have to let you know that it is reported.

CALLER: Well, what would they do?

CLINIC: I’m not really sure.

CALLER: Oh. Would they have to tell my parents?

CLINIC: I’m not really sure from there.

CALLER: Oh.

CLINIC: ‘Cause normally we don’t report it unless, if it’s 14 and up. But you’re under 13, 13 and under it has to be reported.

CALLER: Well, could I get in trouble, or could my boyfriend get in trouble?

CLINIC: It’s possible if they find out his age.

CALLER: Really? What could happen?

CLINIC: I mean, I really don’t know. I don’t know the legality about that. I don’t know.

CALLER: Oh. Well, what if the pregnancy test said that I wasn’t pregnant? Would you guys still have to report it?

CLINIC: If you’re having intercourse? Yes. When you come in for the full exam because we would put down that you’re sexually active and you’ve had a pregnancy test.

CALLER: Oh. Okay. So, well, would I be able to go anywhere that they wouldn’t have to report it?

CLINIC: I’m not really sure about any other clinic’s protocol.

CALLER: Well, he can’t be arrested. I mean, he’s — We’re going to get married, and he’s going to take care of me for the rest of our lives.

CLINIC: Hmm.

CALLER: I mean —

CLINIC: That’s just the law, ma’am.

CALLER: Uh-huh. Well, what can I do then?

CLINIC: I don’t know what you could do. If you come into this clinic, I’m letting you know ahead of time that we have to report that to the police.

CALLER: Oh.

CLINIC: And that he stands the possibility of being arrested. So I do want to let you know that.

CALLER: Well, what —

CLINIC: Plus, we have to send — One of your parents has to bring you for the procedure or you could go before a judge and get what’s called a judicial bypass. But with your situation, I don’t know if that would be good for you to do because of his age.

CALLER: Well, would it be better just not to tell anybody about him?

CLINIC: Well, they’re going to ask you some questions.

CALLER: Yeah? So you don’t think that I could get a judicial bypass?

CLINIC: If you explain that to the judge, it’s possible. I really couldn’t tell you. I really wouldn’t know. Hold on a minute.

CALLER: Okay.

CLINIC: Do you have a good reason for not telling your mother?

CALLER: Well, I can’t tell them at all. I mean, I don’t know what would happen. They’d be furious.

CLINIC: Well, yeah. But I mean, that wouldn’t be a good enough reason for you to tell the judge. You have to be able to convince a judge why are you getting this procedure. You would have to be able to convince him.

CALLER: Well, what should I say?

CLINIC: Girl, I don’t know. In your situation, I don’t know.

CALLER: Well, how could I find out that I was pregnant for sure?

CLINIC: You could take a urine pregnancy test.

CALLER: Oh. Do I come in there for that?

CLINIC: Have you taken the test?

CALLER: No. I’m just really worried because I haven’t had my period for awhile.

CLINIC: Okay. You come here and you take this test, and your test turns out to be positive – we have to report that.

CALLER: But what if it was negative?

CLINIC: If it’s negative, you don’t have anything to worry about. But if your test is positive, then we have to report that.

CALLER: Well, could I get on birth control if it was negative?

CLINIC: Yeah. You can get on birth control.

CALLER: But would you have to tell anybody if I was on birth control though?

CLINIC: No.

CALLER: Really?

CLINIC: Um-um.

CALLER: And my boyfriend wouldn’t get in trouble?

CLINIC: Have you missed a period?

CALLER: Yeah. Haven’t had it since December 21st.

CLINIC: Ooh. So, and you’ve been having unprotected sex?

CALLER: Yeah.

CLINIC: Okay. Well, (sighs) it’s possible that you could be pregnant. And if you are pregnant and you come in here, we’d have to report it.

CALLER: Oh. But if I wasn’t, you wouldn’t have to say anything?

CLINIC: Right.

CALLER: Well, so could I get birth control if I wasn’t pregnant then?

CLINIC: Yes, ma’am, you could get birth control. It’s $28 one-time charge and then the pills are $15 a pack. So your very first pack would be $43, and then it would be $15 a pack after that. But if you have a missed period, then you’re not going to be able to get birth control from us until you have a period.

CALLER: Oh, okay.

CLINIC: You’d have to be on your period to start the birth control pills.

CALLER: Well, would anybody have to know about my boyfriend if I was on birth control?

CLINIC: No, ma’am.

CALLER: Really?

CLINIC: No, long as your test comes out negative.

CALLER: Okay.

CLINIC: So you want to come in?

CALLER: Well, I got to talk to my boyfriend to see. But —

CLINIC: Yeah — you, yeah, that’s something you need to discuss with him, because if you come in here and your test is positive, we have to report that.

CLINIC: In fact, they have to come with you. Your legal guardian or your parent has to come with you to sign an affidavit.

CALLER: Oh. Well, is there any way not to do that, because I don’t know what would happen if they found out. I mean —

CLINIC: The only way you can do that is you have to get ahold of a lawyer, and the judge has to overrule the parents consent and that they will give you a paper to bring to us.

CALLER: Okay.

CLINIC: But the only way you could do that is, you have to get ahold of a lawyer.

CALLER: Yeah.

CLINIC: And he takes it before a judge. And the judge would give you a form saying that, you know — In other words, you got to tell the judge why it wouldn’t be a good idea for your parents to know.

CALLER: Oh.

CLINIC: And if the judge gives his okay, then you bring that paper to us.

CALLER: Okay. Well, how much does a lawyer cost?

CLINIC: I have no idea.

CALLER: Oh. Well, do you know if the judge ever says no?

CLINIC: I don’t know because the people go to different judges. There have been some cases where they bring the letter from the judge.

CALLER: Really?

CLINIC: Uh-huh.

CALLER: Okay.

CLINIC: But it’s just a law now that if you’re under 17 and getting an abortion, your parents do have to sign – your parent or your legal guardian.

CALLER: Okay. Well, I’m just scared because like the whole reason is because like I haven’t had my period since like December 21st, and I don’t know what to do.

CLINIC: Okay. So how far along do you think you are?

CALLER: I’m not really sure.

CLINIC: You’re not sure. Okay. Well, they cost $390 if you’re under 13 weeks. And you say your period was started when?

CALLER: December 21st was my last period.

CLINIC: Okay, that’s when it started?

CALLER: Yeah.

CLINIC: Okay, December 21st. Let me see how far along you are. December 21st. And this is February the 25th. Okay. You would still be considered first trimester. You really will have to get in there like kind of quick, like next Wednesday. We do abortions only on Wednesday mornings, and you will have to, you know, call over there and make your appointment.

CALLER: Well, could I come in for like a pregnancy test though?

CLINIC: Yeah, you can get a pregnancy test. I mean, if you get just the pregnancy test it’s $10.

CALLER: Oh, okay.

CLINIC: Okay? And —

CALLER: My boyfriend said he would pay for anything, for everything. But we were talking about all this, and we decided that we didn’t want anyone to know about us. Would you have to say anything to him? Like he would be the only way I could get there.

CLINIC: Do we have to say anything to your boyfriend?

CALLER: Huh? Yeah. Well, he said he would pay, but he’s just worried. He doesn’t want to sign anything.

CLINIC: He doesn’t. As far as him — I mean, if you want us to tell him about your pregnancy we can, but if you don’t want us to, we don’t have to.
