Life Dynamics, Inc., a national pro-life organization located in Denton, Texas is calling for a criminal investigation into the actions of an abortion doctor who flagrantly violated Florida state law.
When abortionist Michael J. Benjamin performed a late term abortion on a 12-year-old rape victim at his clinic in Tamarac, Florida, he not only failed to report it to law enforcement in violation of state mandatory reporting laws, a third degree felony in the state, but he returned the little girl to the rapist who abused her.
According to Florida state statutes on mandatory reporters of child sexual abuse:
(c) Any person who knows, or has reasonable cause to suspect, that a child is the victim of childhood sexual abuse or the victim of a known or suspected juvenile sexual offender, as defined in this chapter, shall report such knowledge or suspicion to the department in the manner prescribed in subsection
Reporters in the following occupation categories are required to provide their names to the hotline staff:
1. Physician, osteopathic physician, medical examiner, chiropractic physician, nurse, or hospital personnel engaged in the admission, examination, care, or treatment of persons;
2. Health or mental health professional other than one listed in subparagraph 1.;
3. Practitioner who relies solely on spiritual means for healing;
4. School teacher or other school official or personnel;
5. Social worker, day care center worker, or other professional child care, foster care, residential, or institutional worker;
6. Law enforcement officer; or
7. Judge.
After Life Dynamics published a shocking timeline of the events that occurred which documented how Benjamin, two abortion clinics and their staff, as well as employees with the National Abortion Federation (NAF) violated mandatory reporting statutes, our friends at Priests for Life sent out a summary which we will share here:
Jermaine Jones raped Janet Marshall’s 12-year-old daughter in June 2009. In November, her mother took her to the All Women’s Health Center in Gainesville, but was turned away because the girl’s pregnancy was too far advanced.
The NAF hotline then referred Marshall and her pregnant daughter to Benjamin’s office in Tamarac, FL, a six-hour drive away. NAF also helpfully noted that the organization would cover most of the cost of the abortion.
Jones, Marshall and the 12-year-old rape victim traveled together to Tamarac for the multi-day procedure. The Florida Board of Medicine later determined that Benjamin’s “counseling” session with the pre-teen victim lasted six to eight minutes.
According to a report from the Alachua County Sherriff’s office, “There is concern why the medical staff in Tamarac that met with (name redacted) did not notify DCF,” referring to the Florida Department of Children and Families.
In January 2011, the Florida Department of Health filed an administrative complaint against Benjamin for his failure to report the sexual abuse of a minor.
In April 2014, Benjamin was fined $10,000, ordered to attend classes about mandatory reporting, and his medical license was put on probation for two years.
Then, in a bizarre twist, he was put under the supervision of another Florida abortionist, Frank Rodriguez.
In 2006, Benjamin and Rodriguez had worked together at another NAF clinic where a very similar situation happened. Underage girl, adult predator, abortion, failure to report. The predator, this time a teacher, got five years in prison.
Benjamin and Rodriguez were allowed to continue business as usual.
Fr. Frank Pavone, national director of Priests for Life ended by stating, “This kind of criminality is what we find when we dig into the toxic soil of legal abortion. This kind of thing goes on all the time. In fact, a staffer at the Tamarac clinic, when asked why no one reported that a 12-year-old girl was pregnant, commented: “Maybe we’ve been hardened with so many kids coming in.”
According to Florida statutes the penalty for failing to report child sexual abuse includes time in prison and a large fine if convicted, “A person who is required to report known or suspected child abuse, abandonment, or neglect and who knowingly and willfully fails to do so, or who knowingly and willfully prevents another person from doing so, commits a felony of the third degree…Upon conviction, the person may be: • Imprisoned for a term not to exceed 5 years • and Fined $5,000. ”
Mark Crutcher, president of Life Dynamics, wants to know why this abortionist as well as every person who failed this child has not been indicted, “Why is the law enforcement community in Florida not going after Michael Benjamin?” Crutcher asked, “He clearly violated the law by not turning in this predator. In fact, this is something we see going on in the abortion industry every day while the law enforcement community continues to look the other way.”

Crutcher says it is critical that states enforce mandatory reporting laws and prosecute those who fail to report, “We have consistently found that the law enforcement community is functionally indifferent to the problem of abortion clinics not complying with mandatory reporting statutes even in the face of irrefutable evidence that violations are occurring. Among all the cases we researched we never found one example in which criminal charges were brought against an abortion clinic employee for failing to comply with their state’s mandatory reporting statutes. This was true even when this failure was (a) noted during the investigation and/or trial and (b) was a direct contributor to subsequent assaults on these children. In some cases, the abortion clinics flaunting of these laws even resulted in sexual assaults being committed against other underage girls.”
Crutcher says Michael Benjamin’s case is no different and because of his violation of the law, the victim was returned to the pedophile for further sexual abuse, “Why do these people get a pass?” Crutcher asked, “This is a national scandal.”
Crutcher is urging the public to contact the Broward County Sheriff in Tamarac and to call for a criminal investigation into the illegal actions committed by Michael Benjamin.
